These Terms of Service ("Terms") govern your use of the NanoCart platform available at nanocart.app ("Platform"). By accessing or using our Platform, you agree to be bound by these Terms. Please read them carefully before using our services.
1. What NanoCart Does (And What It Doesn't)
NanoCart is your go-to platform for creating simple, focused product selling pages. Think of us as your digital storefront builder, not your business partner or payment processor. Here's the deal:
We provide:
- Easy-to-create product pages
- Hosting for your pages
- Integration tools for your payment systems and analytics
- QR code generation for your pages
- Beautiful themes and templates
We don't:
- Handle your money (payments go directly to you via your chosen payment processor)
- Mediate disputes between you and your customers
- Guarantee sales or customer satisfaction
- Provide legal advice for your business
2. Who Can Use NanoCart
To use our platform, you need to:
- Be at least 18 years old or have parental consent
- Provide accurate information when creating your account
- Have the legal right to sell the products you list
- Comply with all applicable laws in your jurisdiction
If you're representing a business, you confirm you have the authority to bind that business to these Terms.
3. Your Account, Your Responsibility
When you create an account with us:
- Keep your login details secure (we're not responsible if someone else uses your account)
- Provide accurate contact information, especially your email address
- Keep your account information up to date
- Don't share your account with others or create multiple accounts without permission
4. What You Can (And Can't) Sell
We want NanoCart to be a safe, trustworthy platform for everyone. You can sell most legal products and services, but there are some exceptions.
Prohibited Products and Services:
We follow industry standards for prohibited content. You cannot sell or promote products/services that are:
- Illegal in your jurisdiction or the buyer's location
- Subject to copyright infringement or intellectual property violations
- Listed in our Prohibited Products Policy (based on standard payment processor restrictions)
- Adult content or services
- Weapons, explosives, or dangerous materials
- Counterfeit or stolen goods
- Products that violate platform policies of major payment processors
For a complete list, please refer to our Prohibited Products Policy, which mirrors industry-standard restrictions similar to those used by major payment platforms.
Content Standards:
Your product pages must:
- Contain accurate descriptions and pricing
- Include clear, non-misleading images
- Comply with applicable advertising laws
- Not contain spam, malicious code, or harmful content
5. Intellectual Property
Your Content:
You own the content you upload (product descriptions, images, etc.). By using NanoCart, you give us permission to display, host, and distribute your content as necessary to provide our services.
Our Platform:
NanoCart's technology, design, and brand elements belong to us. You can't copy, modify, or use them without permission.
Respect Others:
Don't upload content that infringes on others' intellectual property rights. If you receive a valid copyright complaint, we may remove your content and, in serious cases, terminate your account.
6. Payments and Pricing
Our Pricing:
- Pay-as-you-go: €1.99 per product page per month
- Additional themes, templates, and package plans available
- Custom integration services offered separately
Your Payments:
- You handle all customer payments through your chosen payment processor (Stripe, PayPal, etc.)
- We don't touch your money – all transactions are between you and your customers
- You're responsible for transaction fees charged by your payment processor
- Any refunds, chargebacks, or payment disputes are between you and your customers
7. Third-Party Integrations
You can connect various third-party services (analytics, payment processors, advertising pixels) to your NanoCart pages. Here's what you need to know:
- You're responsible for complying with these services' terms
- We're not liable for any issues, failures, or data breaches from third-party services
- You must ensure you have proper permissions to use tracking pixels and analytics
- Integration problems with third parties are not our responsibility
8. Privacy and Data Protection
We take your privacy seriously and comply with EU data protection laws (GDPR).
What We Collect:
- Your email address and account information
- Usage data through cookies and analytics
- Information necessary to provide our services
What We Don't Collect:
- Data about your customers' visits to your pages (unless you add your own tracking)
- Payment information (this goes directly to your payment processor)
For full details, see our Privacy Policy.
9. Customer Disputes and Transactions
Here's the important bit: All transactions are between you and your customers. This means:
- We don't mediate disputes between sellers and buyers
- Customer service for your products is your responsibility
- Refunds, returns, and exchanges are handled by you
- We're not responsible for product quality, delivery, or customer satisfaction
- Legal disputes about transactions should be resolved between you and your customer
10. Content Monitoring and Account Termination
While we don't pre-approve every product page, we reserve the right to:
- Monitor content for compliance with these Terms
- Remove content that violates our policies
- Suspend or terminate accounts for policy violations
We may terminate your account if:
- You sell prohibited products or services
- You violate intellectual property rights
- You engage in fraudulent or illegal activities
- You repeatedly violate these Terms
- We receive valid legal requests requiring termination
If your account is terminated:
- Your product pages will be taken down
- Your data may be deleted (except as required by law)
- You'll lose access to the platform
- Any prepaid fees are generally non-refundable
11. Disclaimers and Liability Limitations
Platform Availability:
We strive for 99.9% uptime, but we can't guarantee our platform will always be available. Sometimes things break, and we'll fix them as quickly as possible.
Limitation of Liability:
To the maximum extent permitted by EU law:
- Our total liability to you won't exceed the amount you paid us in the 12 months before the claim
- We're not liable for indirect, consequential, or punitive damages
- We're not responsible for lost profits, data, or business opportunities
No Warranties:
Our platform is provided "as is." While we work hard to make it awesome, we can't guarantee it will meet all your specific needs or be completely error-free.
12. Indemnification
If someone sues us because of your use of NanoCart (your content, products, or actions), you agree to defend and compensate us for any costs, damages, or legal fees. This doesn't apply if we're clearly at fault.
13. Changes to These Terms
We may update these Terms occasionally to reflect new features, legal requirements, or operational changes. When we do:
- We'll notify you via email or platform notification
- Significant changes will have a reasonable notice period
- Continued use of the platform means you accept the updated Terms
14. Governing Law and Disputes
For disputes, we encourage friendly resolution through direct communication. If that doesn't work:
- EU residents can use the EU Online Dispute Resolution platform
15. General Provisions
Entire Agreement:
These Terms, along with our Privacy Policy and any other referenced policies, make up the complete agreement between us.
Severability:
If any part of these Terms is found invalid, the rest remains in effect.
No Waiver:
If we don't enforce a provision once, it doesn't mean we've waived our right to enforce it later.
Assignment:
You can't transfer your rights under these Terms. We can assign ours as part of business operations.
